Important information about your order
If the group is reduced to less than 3 participants, we reserve the right to combine groups or reduce the total number of lessons.

Due to the flexible organization, the current teacher may change several times.

We decline all liability for any accidents that may occur during or before the ski course. Accident and liability insurance are the responsibility of the course participants.

A refund of the fee in case of injury or illness is only possible with a doctor's certificate. Only unused days (remaining difference) will be refunded.

Course cancellations due to weather conditions (force majeure) will not be made up. Private courses are held in all weather conditions. The course ticket is not transferable! Unused course days expire!

These terms and conditions apply to all deliveries and services of the ski school based on online bookings via the Internet or other online services.

Online content
The ski school / ski rental (hereinafter referred to as "author") assumes no responsibility for the timeliness, accuracy, completeness or quality of the information provided. Liability claims against the author, which refer to material or immaterial nature caused by use or disuse of the information or the use of incorrect or incomplete information are excluded, unless the author is not intentional or grossly negligent fault.

All offers are subject to change and non-binding. The author expressly reserves the right to change, supplement or delete parts of the pages or the entire offer without prior notice.

Booking and reservation of ski and snowboard lessons
The fees for ski lessons do not include the use of the ski lifts. The ski school does not provide compensation for lesson cancellations caused by the interruption of the lift operation.

Rental and reservation of ski and snowboard equipment
Each renter is liable for the proper return of the equipment up to the amount of the sale price of the rented items.

The rental company is entitled to demand a security deposit, either in the form of a deposit or the deposit of an identification document (e.g. passport, official ID, driver's license). Such security does not represent a possible purchase price for the device.

Place of jurisdiction, place of performance and choice of law
The place of performance is the registered office of the ski school / ski rental shop. In the event of disputes, the court responsible for the registered office of the ski school / ski rental shop shall decide. Austrian law applies to all matters. The contractual language is German.

Registration

Contracts can be concluded in writing, by telephone, electronically or in person with the organiser (element3 OG).

By registering, the customer accepts these general terms and conditions as an integral part of the contract between him/her and the organiser. The organiser may conclude subcontracts with partners and third-party providers for the implementation of the event.

Conditions of participation

Good health is a prerequisite for all events. The client undertakes to inform the organiser of any health problems of the participants. Participation in an event under the influence of drugs, alcohol, psychotropic medication or the like is only permitted at the participant's own risk. Both the client and all participants are obliged to adhere to the conditions of participation and to strictly follow the instructions of the organiser, trainers and assistants. If these conditions are not met or the instructions are not followed, the organiser reserves the right to exclude participants from the activity. In case of exclusion, the cancellation regulations apply, whereby exclusion is equivalent to a no-show.

Liability

Participation in the incentive programmes, team events, events, outdoor activities and seminars takes place on a voluntary basis and at the client's own risk. The organiser also acts as an agent for the customer for products and services of other activity organisers. No liability for contract fulfilment, accidents, delays, losses or other irregularities can be assumed from this intermediary activity. If the organiser delegates the execution to a third party, the organiser shall not be liable for the acts and omissions of that third party. If the instructions of the organiser or its auxiliary persons are not followed, any liability on the part of the organiser shall lapse. The liability of the organiser for any damages due to slight negligence as well as for financial losses is excluded.

Picture and video recordings during the event

By participating in our events, guests/participants acknowledge and agree that we may make image and sound recordings (in particular in the form of photos and videos) of the event and its participants for the purpose of documentation and public reporting by photographers commissioned by us. These recordings may be stored and processed digitally and published in various media (e.g. print media, offers, homepages, social media). Images and sound recordings made are generally stored for up to 3 years; in individual cases, recordings may be stored for longer for archiving and documentation purposes. You have the right to revoke this consent at any time without affecting the lawfulness of the processing carried out on the basis of the consent until revocation. You also have the right to information, correction, deletion, objection and data portability as well as the right to lodge a complaint with the data protection authority.

Terms of payment

A deposit of half the cost of the event is due upon booking. The remaining amount is due within 14 days after receipt of the invoice without deduction.

Cancellation costs

- 30% of the total amount as of order placement

- 50 % of the total amount between 60 and 30 days before the event

- 75 % of the total amount between 29 and 14 days before the event

- 100 % in case of later cancellation or no-show

Withdrawal of the organiser - Change of programme

If, due to unforeseeable circumstances (force majeure, weather and natural conditions, official measures or safety risks), the planned programme cannot be carried out, the organiser reserves the right to adapt it accordingly or to carry out a substitute programme.

Place of jurisdiction

For all disputes arising from this contract, the local and subject-matter jurisdiction of the District Court of Kitzbühel is agreed.
